Abstract

The chapter deals with the contract in favour of a third person. The position of Roman law is demonstrated (where the principle "alteri stipulari nemo potest" was applied), then the change of attitude in French private law is demonstrated.

This change has been projected also in German and Austrian theory of private law. Following this, corresponding features of nowadays legal regulation are analyzed in comparison with former regulation enacted in Austrian General Civil Code.
