Nature and prerequisites for Member State liability under Article 7 of the SEU

Abstract

The purpose of this contribution is to define the responsibility of the Member State under Article 7 of the TEU. This means defining the meaning and purpose of this rule, which introduces the penalty for a Member State's offense, which I call a European offense.

I therefore define that term and describe the Member State's own responsibility for that act in the context of other EU law regimes of responsibility.
