Capital Markets Union is getting closer: the next step is to implement the new conflict-of-law rules for identifying the law in respect of the third-party effects of assignments of claims

Abstract
Proposal for the Regulation of the European Parliament and of the Council on the law applicable to the third-party effects of assignments of claims [2018/0044(COD); hereinafter the "Proposal"] was published in March 2018. The Proposal pursues an aim of enhancement of a legal certainty for cross-border transactions in claims, in particular with regard to the issue of determination of an applicable law in respect of the third-party effects of assignments of claims.
The Proposal is currently pending consideration by the Parliament at the first reading under the ordinary legislative procedure.
