Humanism as a way to fair decision-making

Abstract

Humanism as a philosophical approach focusing on human being and accepting every person with all its good and bad characteristics, emphasizing the equality of all human beings and believing in ability of every person to self-development and becoming who he/she really is, may find its expression also in judicial decision making if the judge himself/herself has humanistic view of the world. The hypothesis which will be demonstrated in this paper, is, that the humanistic decision making contributes to fair decision making; that the humanism is a way to fairness.
