The Future of the European Public Prosecutor's Office

Abstract

The contribution deals with Council Regulation (EU) 2017/1939 of 12 October 2017 on the Establishment of the European Public Prosecutor's Office. This project is a significant manifestation of the unification of European criminal law and its departure from the traditional judicial cooperation between states towards a unified and controlled investigation of crimes against the financial interests of the European Union throughout its territory.

At the beginning, the new office will have jurisdiction only over 20 EU member states under so-called enhanced cooperation. The European Public Prosecutor's Office will not assume its investigative and prosecutorial tasks earlier than 3 years after the regulation's entry into force.

The article describes the reasons for the introduction of this concept, arguments against its establishment and potential problems which might arise upon its establishment and functioning.
