The contribution is a token of reverence to recently departed doc. Herczeg, and focuses on one of the areas of expertise that doc.
Herczeg undertook on his scientific activity, that being the principle nemo tenetur, especially in relation to criminal proceedings against legal persons. It does not focus in detail on the sole foundation of this principle, but focuses on its use in relation to legal persons, where both theory and practice did not yet take a definitive stance towards some partial questions.
The author concludes that the principle nemo tenetur in criminal law is applicable in a similar manner as in criminal proceedings against persons, with the exception of some specifics arising from the very nature of a legal person. The practice itself is, however, yet to show the validity of the opinions presented in the contribution.
