Abstract
The paper deals with the constitutional law aspects of administrative punishment, specifically deals with the question of the prohibition of liquidation fines, based on the case law of the Constitutional Court of the Czech Republic on the basis of article 11 of the Charter of Fundamental Rights and Freedoms of the Czech Republic. The paper summarizes the theoretical bases of the probihition, describes its reflection in the case law of the administrative courts and the consequences of the prohibition of liquidation fines in the sphere of legislative activity and (especially) in the field of individual decision-making process.
