The principle of material equality in the decision-making practice of public administration

Abstract

The paper is devoted to projecting the principle of equality in the resulting administrative decision. It points to the limits and relativity of such a request.

It addresses the question of the extent to which the financial circumstances of the addressee of the decision should be taken into account when administrative penalties are imposed. Also some links between the principle of equality and the principle of legitimate expectations are mentioned.
