Abstract

The paper aims to clarify the possible impacts of the constitutional principles beyond legally set rules in the exercise of public authority, in particular taking into account possible occurrence of damages. In my paper I determine which authority is competent to decide on illegality of public authority decisions, the timing and the consequences of this review activity in terms of damages for decision-making of courts.
