The fourth chapter, titled "Effects of fundamental rights on legal relationships of juristic persons", answers the following question: In what way do fundamental rights, as currently broadly construed by the courts, affect legal acts and responsibility (liability) of juristic persons? This is a very important topic in terms of examination of legal acts performed and the responsibility (liability) borne by juristic persons because, in contemporary law, both legal acts and liability of juristic persons are inherently associated with certain limits as well as with new entitlements that follow from constitutionally guaranteed fundamental rights and freedoms. The chapter deals with the doctrinal background regarding the effects of fundamental rights on legal relationships of juristic persons, the duties ensuing for juristic persons from fundamental rights, and also the position of the state and its positive obligations.
This chapter aims not only to provide a theoretical analysis of the given subject, but also to examine practical application of the law, especially in courts' decision-making. Therefore, the fourth chapter offers not only theoretical conclusions, but also a quantitative and qualitative analysis of the decisions rendered by the Constitutional Court of the Czech Republic over the past two decades.
