Tax oligations in the light of legality and case law

Abstract

According to a steady opinion, taxes constitute a state interference with taxpayer's property. The reason for this interference is the interest of the state, because without imposing taxes it would not be possible to secure the resources in order to fulfil the functions of the state.

This does not mean, however, that the legislation could impose taxes without restriction.
