Principle of Contradictory in Criminal Proceedings - European Context and Czech Reflection

Abstract

The paper deals with one of the basic principles of criminal proceedings, namely the principle of contradictory. This principle is not conceived uniformly in legal science and the author deals with the European context and its concrete Czech reflection, especially in court proceedings.

He then concludes that the European requirements of the adversarial principle are already well represented in the Czech continental proceedings, but that some of their elements can be further strengthened.
