This article deals with the issue of explicitly laying down the basic principles of criminal procedure in the Criminal Procedure Code. The basic principles of criminal proceedings are a certain regulatory idea, on the basis of which criminal proceedings are built and controlled.
The author is of the opinion that the basic principles of criminal procedure should be presented in a concentrated form in the new Code of Criminal Procedure in the introductory provisions of the Code, mainly due to the functions that they fulfill. A supportive argument is also that there is a certain legislative tradition in the Czech Republic to formulate the basic principles of criminal proceedings in the introductory provisions of the Act.
