Abstract

he article deals with provision 13 of the CzCC, its discoursive aspects in the light of two recent decision of the Supreme Court. The core of the article is the analysis of discussion concerning stare decisis and right to receive explanation of overruling in the context of judicial review and change of social and economic reality.
