Judicial oversight of sports associations in the Czech Republic - does the new Civil Code strike the right balance between autonomy and intervention?

Abstract

In the Czech Republic (as in many other countries), sports clubs and organisations conduct their activities the most frequently within the legal form of associations (except for clubs in professional leagues). The typical feature of the right of association that is also applicable to sports entities is the "autonomy of associations", which, apart from other aspects, is manifested in the principle of the separation of associations from the state.

This article explains the limits of one of the most important interventions of state authorities in activities of sports clubs and associations - the review of a decision of a body of an association by a judicial authority.
