A controversy with the Supreme Court's view of the so-called other non-material harm in bodily harm

Abstract

The Supreme Court, through the Methodology and the related case-law, is embarking on a much more restrictive view of the institute of other non-material harm, which in my opinion is the result of incorrect (tendency) argumentation and insufficient consideration of the basic principles of the new Civil Code.
