The assessment of conformity of national legislative proposals with international and European law constitutes an important phase of the legislative procedure at the national level. The assessment should be carried out thoroughly and should focus on the identification of relevant European and international human rights norms including case law issued by the European Court of Human Rights and the EU Court of Justice.
Some examples from Czech legislative practice illustrate how important it is to establish the primary legal reference for human rights protection, especially in complicated cases when different norms of a national constitutional, international and European protection apply.
