Some Aspects of the Judge's Participation in Preliminary Proceedings

Abstract

The author presented selected aspects of the extensive issue of the participation of a judge in preliminary proceedings, especially the decision-making process related to the applicability of protocols on the hearing of witnesses who were not heard in the presence of the accused person and whom the accused person never had an opportunity to ask questions. In this connection, he also approached proposals for the rules governing the course of the evidence in the future Criminal Procedure Code.
