This chapter deals with one of the fundamental principles of criminal proceedings - the principle of free evaluation of evidence, which is organically linked with the other principles of evidence, in particular the principle of ascertaining the facts beyond a reasonable doubt, the investigative (search) principle and the principle of presumption of innocence. This important principle of the criminal process is viewed by a doctrinal, normative and judicial view.
The author concludes that this principle should be retained in the new Criminal Procedure Code.
