On the History of the Distinction between Rules of Transportation and Transport Terms of Service

Abstract

Within the legal framework of passenger transport, there is sometimes a confusion (or mixing) between transport regulations and contractual transport conditions. The authors are highlighting the need to distinguish between generally binding legal regulations (rules of transportation) and Transport Terms of Service (contractual conditions of carriage, which are not generally binding) and point to the historical roots of this distinction, which can be already described in our country as traditional.
