An Engagement in the Czech Legal History (Some Remarks with an Accent on the Early Modern Period)

Abstract

An engagement is an ancient legal institute. It is a double-sided commitment of two persons that they will enter into marriage in the future.

In presently valid Czech Civil code from the year 2012, this institute is not included, as well as in previous codes from the communistic era. Last time some legal consequences were associated with it in Austrian ABGB, today it is also known by the canon law.

The study tries to point to the significance of the engagement in Bohemian background especially in the early modern age and to bring reader's attention to some sources and connections.
