Disputes over the basic principles of criminal procedure

Abstract

This paper deals with selected basic principles of criminal proceedings, namely the principles of initiation of legality and opportunity, the principle of adversariality and the concept of the burden of proof. The topic of the paper was chosen with regard to the fact that Professor Jelínek focuses on the concept of criminal proceedings continuously, while warning against the reckless adoption of foreign elements into the continental model of criminal proceedings.

The central role in the concept of criminal proceedings is played by the basic principles of criminal proceedings, which the author of this paper developed under the expert guidance of Professor Jelínek in his dissertation (later published as a monograph).
