Abstract

The subject of this paper is the functions and systematics of the principles of substantive criminal law, especially in the context of the system of substantive and procedural criminal law. The starting point of the basic principles of substantive criminal law follows primarily from the function of substantive criminal law, which he sees as a protective, preventive, repressive and regulatory function.

The basic principles of substantive criminal law will thus also be embedded in the system of legal principles as such, as well as explained in the constitutional context.
