A Missing Person. Commentary on Section 66 to 70 of the Civil Code

Abstract

The paper contains a systematic interpretation of the legal institute of a missing (absent) person. Attention is paid to the assumptions of its commencement, the declaration of a person as missing (absent) by the court and the legal consequences of the absence, both the factual absence and the absence declared by the court.

Attention is also drawn to the connection between this institute and the declaration of death on the basis of a presumption of death.
