Geoblocking from the perspective of changing legal regulation in a globalized society

Abstract

The development of the internet and its usage brings many advantages, but also some new barriers within the internal market of the EU. Geoblocking is a method used primarily in international trade to block access to websites or applications from users from other countries.

As this blockage represents a new barrier in the internal market, the European Geoblocking Regulation has been issued and is being examined in this paper. In particular, the author objects that the Geoblocking Regulation does not apply, especially, to the areas of audio-visual and copyright-protected works or the sale of airline tickets, which were identified as being the most affected by geoblocking before the regulation was issued.

Thus, the negative scope of the Geoblocking Regulation established undermines the very purpose of that regulation to some extent, namely the removal of geoblocking as a barrier in the internal market.
