Individuals before the National Contact Points by the OECD Guidelines for Multinational Enterprises

Abstract

It is typical for the international economic law that it allows broad participation of non-state actors, principally with regard to dispute settlement. The mechanism established by the OECD Guidelines for Multinational Enterprises is particularly distinctive in this regard.

Therefore, this contribution investigates the practice of handling specific instances in cases of alleged violation of the OECD Guidelines before National Contact Points. An individual plays a significant role in this process as a person benefiting from rights under international law, a complainant - the Party to the specific instance, or a participant during the monitoring and implementation phase of recommendations given to a multinational enterprise.
