Eu CITIZENSHIP AND ITS IMPACT ON MIGRATION FROM THIRD COUNTRIES TO THE EU

Abstract

The contribution critically points out that the CJEU has also developed EU citizenship and EU right of free movement in such a problematic way, which contributes to migration into the EU and frustrates the efforts of many EU member states to effectively control and regulate such migration. The CJEU did so especially in the Metock, O and B and Zambrano cases, which are analysed in the contribution.

Furthermore, the contribution wonders that despite unabated migration pressure on the EU and Brexit, there is no will in the CJEU to reconsider these cases. On the contrary, the CJEU has recently even reinforced migration impacts of these cases in the Coman, Lounes and Chenchooliah judgments.
