A shared economy, or where is the burden of responsibility?

Abstract

The paper focuses on selected aspects of civil liability in relation to shared economy services. Who is actually responsible in civil law? Shared economy services are usually based on existing - somehow legally enshrined - concepts, such as taxi service, bank loans or accommodation services, etc., and transform them into a new (usually online) form.

Online service providers often act as a mere technology platform for a peer-to-peer ("peer-to-peer" or "client-client") service, which does not bear any responsibility, as it only provides the necessary (technical) background for its users.
