Non-Pecuniary Loss and Just Satisfaction in the World of Legal Entities

Abstract

The article focuses on the non-pecuniary loss suffered by legal entities and just satisfaction from the point of view of the Czech law. The author examines whether a legal entity may suffer non-pecuniary loss and difference of such loss from the nonpecuniary loss suffered by a human.

Special attention is paid to the nature of loss and just satisfaction in the law against unfair competition and interference with the fundamental rights of legal entities and its redress under the European Convention on Human Rights. The outcomes are based on an analysis of the legislation and case law of the Supreme Court and the European Court of Human Rights.
