New technologies in the case-law of the ECtHR

This article provides a brief overview of the case-law of the European Court of Human Rights (ECtHR) on new technologies. It discusses the areas classified as 'new technologies' in the practice of the ECtHR.

The author set forth the list of Articles of the European Convention on Human Rights (ECHR) relating to the protection of digital rights. The analysis of four judgments of the ECtHR of 2020 in respect of the Russian Federation is conducted in order to demonstrate the difficulties, which may face Russian legislation and practice in the future.

The European Court has already recognised that the Russian telecoms regulator's (Roskomnadzor) practice of blocking websites and certain provisions of the Russian Information Act do not comply with the ECHR. The complaints about the use of mobile applications monitoring the location of individuals applied to fight against COVID-19 without the required informed consent can be expected in the future
