This contribution describes the way in which the Czech private law deals with woody plants. It focuses on the issue of ownership of plants and on laws regulating neighbour disputes, both from the perspective of legal and historical sciences.
The article investigates whether it is possible for plants to grow on a plot of land without being its part, and under what conditions this can be the case. Trees and bushes can have a negative impact on neighbouring plots of land, especially in the form of 'immissions', but also as shoots that creep under or through the property divide or overhang it.
The article also deals with the issue of preventive measures against the planting of trees close to property lines.
