Abstract
The issue of forced heirship is one of the most widely discussed topics, but there are several practical issues connected with it, that are hard to resolve. In this treatise, I intend to analyze all situations in which the position of the forced heir is not the testator's child, but his more distant descendant.
Does the final assessment depend on the reason for which the next child lost his right to the compulsory portion? Are minor grandchildren or great-grandchildren entitled to a compulsory portion in the amount of one quarter or three-quarters of their legal inheritance share?
