Possibility of speeding up the administrative justice

Abstract

The article deals with the possibility of speeding up administrative justice by extending the competence of specialized single judges as opposed to specialized court chambers. It explores that the current form of division of competence between specialized single judges and chambers provided for in the Code of Administrative Procedure is not based on a uniform and logically deductible principle.

The extension of the competence of single judges in the Code of Administrative Procedure is evaluated in the context of the regulation of professional judges' participation in the Code of Civil Procedure and the Criminal Procedure Code and compared with the regulation effective in Slovakia. It concludes that a possible extension of the competence of specialized single judges could speed up administrative justice, contribute to the relief of the Supreme Administrative Court and pave the way for a broader change in the regulation of administrative justice.
