Abstract

The EU's approach to family law issues in general and to the institution of marriage in particular is somewhat ambivalent. While the Treaties and legislative acts explicitly emphasize the sovereign competence of the Member States in this area, the case law of the Court of Justice of the EU has shown some potential for EU intervention in national family law.
