Impacts of the amendment to the Criminal Procedure Code made by Act No. 333/2020 Coll. on the basic principles of criminal procedure
Abstract
The article deals with some impacts of the amendment to criminal regulations made by Act No. 333/2020 Coll. in terms of the basic principles of Czech criminal proceedings. This amendment introduced some important changes to the Criminal Procedure Code (statements on the indictment, extension of the applicability of the guilt and punishment agreement as well as undisputed facts, as well as the new institute of guilt), which to some extent changes the current nature of criminal proceedings.
The discussed institutes, which to a large extent conflict with the basic principles of criminal proceedings (§ 2 of the Criminal Procedure Code), resp. represent their exceptions, they represent a significant step towards the Anglo-American criminal process.
