Abstract
The author analyzes the impact of committing a crime during a state of emergency. He draws attention to the initial misinterpretation of the legal provisions by the courts, resulting in disproportionately high penalties for petty theft.
The author also deals with the different legal stances, that the Supreme Court has gradually taken over time on the outlined issue. In addition to selected legal aspects, the paper points out numerous application issues and adverse consequences the practice has caused to a large amount of convicts.
