Selected aspects of the applicability of the protocols on previous witness statements in the main trial with regard to the case law of the ECHR

Abstract
The author outlined some aspects of decision-making process related to applicability of protocols on hearing of witnesses who were not heard in the presence of the accused person and whom the accuesed person had never an opportunity to question. He also approached the proposals for the rules governing the course of the evidence in the future Criminal Procedure Code.
