Obligation and Liability in Civil Substantive Law and Civil Procedural Law. Special Problems

Abstract

The collective monograph focuses on one of the fundamental legal issues, namely liability. However, the concept of liability would be meaningless if attention were not also paid to the concept of (legal) obligation in its various forms, which is a prerequisite for any consideration of liability in law.

In the individual chapters of the book, selected issues of liability in civil law, family law, commercial law, labour law, financial law and medical law are analysed. A part of the publication is then devoted to liability issues and problems that are particularly related to the tools of modern information technology (AI).

Liability relations cannot be neglected in civil procedural law either, where the text of the publication aims to discuss mainly basic general topics. This collective monograph, written mainly by young legal researchers, but also by erudite academic scientists and practitioners, does not aim to be a complete or comprehensive treatment of the topics defined by the title of the publication.

This is not even possible. Rather, it is intended to open up a debate and define a space for dialogue on the specific problems associated with liability in private law and civil procedural law.
