Professional Confidentiality in Mediation: How not to Have Ears of a Donkey

Abstract

The article addresses the issue of confidentiality as applied in mediation. It tackles both the questions of persons obliged and of the extent applicable.

The confidentiality still proves to be an important accent within the ADR world. It is used to protect the important pieces of information in the case of commercial disputes and intimate details of the parties' lives in neighbourhood and family conflicts.

The article attempts to critically analyze the confidentiality rules and application both according to the Czech Mediation Law and the Slovak Mediation Law.
