Recently, the Supreme Court of the Czech Republic has issued several decisions concerning a notarial deed of agreement by which a participant shall undertake to pay a debt or to satisfy other claim of a second participant arising from a legal relationship based on obligation, in which he/she gives consent to impose and execute the decision (execution) under such deed and to use such a notarial deed as a power of execution unless he/she meets his/her obligation duly and on time. The main objective of this article is to analyse in detail one of these judicial decisions, which specifically deals with a notarial deed in which the obliged person has consented to the enforceability of his obligation to evict certain immovable property.
The article also refers to two other decisions on this topic, which it also briefly evaluates.
