The text gives an interpretation of the provisions on possession. The text takes into account the current state of Czech legal scholarship and case law and takes into account foreign legislation, in particular Austrian, German and Swiss legislation.
Attention is paid to fair possession, protection of possession. A basic interpretation of possession is also given, where possession is a basic prerequisite for possession.
