Business entities in proceedings before the European Court of Human Rights and challenges related to COVID-19

Abstract

The aim of this manuscript is to describe the problematic aspects of the legal standing of business entities in the proceedings before the European Court of Human Rights (ECtHR). The article focuses on the following three issues: 1) the influence of the form of ownership on the possibility to lodge a complaint with the ECtHR reflecting the status of state-owned companies; 2) obligations of business entities under the ECHR and the idea of attribution of the conduct of business entities to the state; 3) the challenges associated with Covid-19 concerning business entities and possible liability under the ECHR.

The structure of the paper corresponds to the answers to these three research questions.
