Until recently, the regulation of crowdfunding in the EU was not harmonized and different national regulations, or. the absence of special regulation has made it difficult to provide these services across borders. This has been changed by Regulation (EU) 2020/1503 of the European Parliament and of the Council of 7 October 2020 on European crowdfunding service providers for business, and amending Regulation (EU) 2017/1129 and Directive (EU) 2019/1937 applicable since 10 November 2021, which allows any provider with a license issued by the competent authority of its home Member State to provide cross-border crowdfunding services at Union level.
The aim of this article is to introduce the reader to the new EU regulation of financial crowdfunding and the requirements for crowdfunding service providers, and at the same time to point out the current problems associated with the implementation of the regulation in practice and possible overlaps with existing financial market regulations.
