The Video Last Will and Testament (In video veritas?)

Abstract

The presented article deals with the last will captured on an audiovisual recording, which, although not permissible in the Czech Republic or in the legal systems in which we most often look for inspiration, has already been allowed abroad. The article tries to find answers to essential questions such as: What are the conditions under which video wills have been admitted in foreign jurisdictions (especially in Australia)? What risks should not be forgotten when considering video wills? Can these risks be easily eliminated, or would it be better not to allow video wills at present? What are the advantages of video wills? Can video wills be placed in the context of the recent legal system? etc.

In the light of these answers, it is then evaluated whether video wills should enrich domestic private law or not.
