Abstract
The article deals with the concept of legal capacity in private law. After a brief historical exposition, from which it is necessary to distinguish between the current and historical (Roman law) concept of legal capacity, attention is paid to recent amendments to this legal institute, while critically pointing out their problematic aspects.
For the sake of completeness, the current discourse regarding the legal capacity of legal persons is also mentioned.
