THE NEW EUROPEAN REGULATION OF CRYPTOASSETS MICA

Abstract

This article is devoted to the issue of regulation of crypto-assets with a focus on the emerging MiCA (Markets in Crypto-Assets) regulation. The aim of this article is to provide a basic introduction to the issue, highlight controversial points and assess the appropriateness of the proposed regulation.

Firstly, the article introduces the intentions of the regulation as well as the socio-technological background that explains the rationale and the need for the regulation. Secondly, the article describes the different areas regulated by the regulation.

These are mainly areas of stablecoins and Crypto Assets Service Providers. Both of these areas are discussed in detail later on.

The key part of the second part of the article is categorization of stablecoins and defining the differences between these categories. The same procedure is applied to the area of Crypto-Assets Service Providers.

Lastly, the article discusses changes that have occurred during the process of adoption of the regulation. Conclusion consists of the evaluation of the changes that have been made during the process.
