Damage caused by buildings under Czech, German and Austrian law

Abstract

The study deals with tort liability for damage caused by a building, namely its collapse or collapse of part of it. It is a comparative analysis of legal regulations in the Czech, German and Austrian legal system.

Contrary to the prevailing opinion in Czech doctrine, the article takes the view that in the given case it is subjective responsibility under stricter requirements. The owner of the building cannot be imposed objective liability, which is not admissible in either German or Austrian law.
