Abstract
Act No. 182/2006 Coll., the Insolvency Act, as amended, classifies the insolvency administrator as a procedural entity. The purpose of this paper is to find the theoretical basis for the position of the insolvency administrator in insolvency proceedings, with the help of our legal doctrine, judicial interpretation and, marginally, German legal theory.
At the same time, we will answer a related question concerning the possible liability of the state for damage caused by the insolvency administrator.
