Proportionality in the Constitutional Law of the Czech Republic - Doctrinal Research and Judicial Development

Abstract
The presentation at the conference was devoted to the development of the principle of proportionality in Czech constitutional discourse and especially the role of Professor Pavel Holländer in the development of this method of constitutional argumentation. It was emphasized that the practice of the Czech Constitutional Court reflected the theoretical problems of proportionality, in particular the need for variable intensity of judicial review with respect to the requirement of the legislator's discretion.
