The relation between asylum and return procedures in the EU law - tool for more effective return policy

Abstract
The proposal for a revised Return Directive also includes as one of its priorities a better link between the return procedure and the asylum procedure. It is the lack of integration of asylum and migration management at EU level, which is then negatively reflected in the Member States, that the EC identified in the Pact as one of the challenges in the monitored area of the relationship between asylum and return.
This paper presents the main background and elements of the negative asylum-return decision nexus. It also draws attention to the substantive and legal problems associated with that link, within the framework of an at least partly holistic view of the topic under study.
